Terms and Conditions for all Transfers and Services
مقدمة:
Introduction:
يتم توفير خدمة تحويل الأموال ("الخدمة") من قبل وول ستريت للصرافه وول ستريت للصرافه وشبكة من البنوك والمؤسسات المالية ("ممثلينا"). تشكل هذه الشروط والأحكام وأي شروط أخرى مشار إليها هنا وجميع النماذج والإيصالات المطلوبة ("الوثائق") الاتفاقية الكاملة ("الاتفاقية") بينك وبين وول ستريت للصرافه، متلقي الخدمة ("أنت" أو "الخاص بك"). تنشئ الاتفاقية التزامات ملزمة قانونًا عليك وعلى خلفائك و ورثتك
1.1 The money transfer service ("Service") is provided by Wall Street Exchange Centre LLC (“WSEC”) and a network of banks and financial institutions (our "Representatives"). These terms and conditions, any further terms referred to herein and all requisite forms and receipts (the “Documentation”) constitute the entire agreement ("Agreement") between WSEC and you, the recipient of the Service ("you" or “your”). The Agreement creates legally binding obligations on you, your successors, and heirs.

1.2 You acknowledge that you accept the terms of this Agreement and have read and confirm the accuracy of the information contained in the Documentation.
.تحتفظ وول ستريت للصرافه بالحق في استخدام خدمات الممثلين في أي بلد تختاره لتنفيذ تحويلات الأموال ("التحويل"). تنطبق رسوم المراسل و/أو الوسيط على بعض البلدان وسيتم دفع هذه الرسوم من قبل المستلم أو خصمها من الأموال المستحقه له
1.3 WSEC reserves the right to use services of Representatives in any country of its choice for the execution of the money remittance transfer (“Transfer”). Correspondent and/or intermediary charges are applicable for some countries and such charges will be paid by, or deducted from monies owed to, the Recipient.

1.4 In addition to offering the Services, Representatives offer their own products or services. Any products or services offered by a Representative that are not part of the Service are offered solely by the Representative, under separate terms and conditions.

1.5 This Agreement does not confer and is not intended to confer rights or remedies on any person or entity other than you and WSEC.

Transfers:
.سيتم دفع التحويل بعد تحويل المبلغ المحدد بعملة الدوله المرسلة إلى عملة الدوله المتلقية أو أي عملة محددة أخرى، وفقًا لسعر الصرف المطبق في وقت إصدار تعليمات التحويل
2.1 A Transfer will be paid after the designated amount in the currency of the sending territory is converted into the currency of the recipient territory or any other designated currency, in accordance with the exchange rate applicable at the time that the Transfer is instructed.
إذا كنت تريد التحويل ("المرسل")، تعتمد وول ستريت للصرافه على المعلومات التي تقدمها لنا لإرسال الأموال. يرجى مراجعة جميع تفاصيل التحويل للتأكد من دقتها قبل إكمال تعليمات التحويل. إذا كنت تقوم استلام حواله، فإنك توافق على أنك المستفيد المحدد من التحويل ("المستلم") وأنك قمت شخصيًا بتحصيل الأموال المستلمة. عند التوقيع على الإيصال، يؤكد العميل ويقر بصحة جميع تفاصيل المعاملة وصحتها وقانونيتها وسيكون مسؤولاً عنها. يجب أن يتم دفع جميع رسوم مستحقة عليك قبل معالجة عملية النقل
2.2 If you are instructing a Transfer (the “Sender”), WSEC relies on the information you provide us to send money. Please review all details of the Transfer for accuracy before completing the Transfer instructions. If you are collecting a Transfer, you agree that you are the named beneficiary of the Transfer (the “Recipient”) and that you have personally collected the funds received. Upon signing the receipt, the customer confirms and acknowledges the correctness, authenticity and legality of all the transaction details and will be held responsible for the same. Any charges payable by you must be paid before the Transfer is processed.

2.3 In certain circumstances the Sender or WSEC may cancel the Transfer at any time before collection by the Recipient such that the Recipient will not be authorized to receive the Transfer.
إشعار مهم: المبالغ المستردة مقابل إلغاء المسودات أو التحويلات أو أي معاملة تحويل أخرى يتم إرجاعها غير مدفوعة لأي سبب من الأسباب سيتم ردها إلى المرسل بسعر الشراء السائد في السوق أو سعر المعاملة أيهما أقل، باستثناء رسوم الإرسال، وأي خصومات من البنك المستفيد ورسوم الإلغاء وأي نفقات أخرى يتم تكبدها نتيجة لذلك. مطلوب تأكيد عدم الدفع وإلغاء التعليمات الأصلية من البنك المراسل لدينا قبل استرداد المبلغ. يجب على المرسل تسليم الإيصال الأصلي إلى متجر وول ستريت للصرافه لبدء إجراء الإلغاء, في حال كان المرسل شركة، يمكن إجراء المبالغ المستردة أو التعديلات من خلال الممثل المعتمد ولن يتم استردادها نقدًا تحت أي ظرف من الظروف. سيتم استرداد المبلغ من خلال أحد المتاجر عن طريق شيك لصالح المرسل الخاص بالشركة. وول ستريت للصرافه ليست مسؤولة عن أي تأخير ناتج عن طلب الإلغاء أو استرداد الأموال
2.4 Important notice: Refunds against cancellation of drafts, Transfers or any other remittance transaction returned unpaid for whatsoever reason will be refunded to the Sender at the prevailing market buying rate or transaction rate whichever is lower, excluding the sending charges, any deductions from the beneficiary bank, cancellation fees and any other expenses incurred as a result. A confirmation of non-payment and cancellation of the original instruction is required from our correspondent bank before a refund is made. The Sender must surrender the original receipt to the WSEC store to initiate the cancellation procedure. In case the Sender is a corporate, refunds or amendments can be conducted through the authorized representative and will not be refunded in cash under any circumstances. The refund will be made through a store by a cheque favoring the corporate Sender. WSEC is not liable for any delay caused further to a cancellation or refund request.
بالنسبة للتحويلات المدفوعة عن طريق الشيكات، يجب أن يكون الشيك موثقاً بالتاريخ الذي بدأ فيه العميل المعاملة وجعلها مستحقة الدفع لشركة وول ستريت للصرافه. ستتم معالجة مثل هذه المعاملة بعد معالجة شيك الدفع والائتمان الكافي في الحساب البنكي لشركة وول ستريت للصرافه. في حالة عدم سداد شيك الدفع أو رفضه لأي سبب كان، يوافق العميل على تسوية كامل المبلغ المستحق والواجب السداد لإجراء التحويل مع الأخذ في الاعتبار أي رسوم ومصاريف وتغييرات في سعر الصرف، نقدًا. في حالة حدوث نزاع، تحتفظ وول ستريت للصرافه بالحق في إلغاء النقل دون إشعار واتخاذ جميع الإجراءات القانونية اللازمة لحماية حقوقها واسترداد جميع المطالبات ذات الصلة
2.5 For Transfers paid by cheque, the cheque must be dated with the date that the transaction is initiated by the customer and made payable to WSEC. Such a transaction will be processed subsequent to processing of the payment cheque and adequate credit in WSEC’s bank account. In case a payment cheque is not honored or is rejected for whatsoever reason, the customer agrees to settle the full amount due and payable to affect the Transfer taking into account any fees, charges and changes to the exchange rate, in cash. In case of a dispute, WSEC reserves the right to cancel a Transfer without notice and take all necessary legal action to protect its rights and recover all related claims.
.تعتبر التحويلات منفذة ومُسلَّمة ما لم تقم بتسجيل مطالبة لدى وول ستريت للصرافه في غضون ثلاثة أشهر لتحويل الدفع النقدي، أو ستة أشهر للتحويل المصرفي، من تاريخ إجراء التحويل
2.6 Transfers are considered executed and delivered unless you register a claim with WSEC within three months for a cash payout transfer, or six months for a bank transfer, from the date that the remittance was made.
.يعتمد توفر الخدمة والأموال على عدد من العوامل بما في ذلك الخدمة التي اختارها المرسل، بما في ذلك خيارات التسليم المتأخر، وبلد الوجهة، وساعات عمل الممثل، وفروقات المنطقة الزمنية، ومبلغ التحويل، وتوافر العملة، ومتطلبات تحديد الهوية، والمتطلبات القانونية و التدقيق المطلوب.
2.7 Service and funds availability depends on a number of factors including the service chosen by the Sender, including delayed delivery options, destination country, the Representative’s hours of business, time zone differences, the transfer amount, currency availability, identification requirements, and legal and regulatory compliance.

2.8 You may be charged for the receipt of a Transfer. You agree that you are the named beneficiary of the Transfer and that you have personally collected the funds received. Upon signing the receipt, you confirm and acknowledge the correctness, authenticity and legality of all the Transfer details and will be held responsible for the same.
يعد تسجيل العميل إلزاميًا باستخدام بطاقة هوية صالحة يحددها مصرف الإمارات العربية المتحدة المركزي لمبالغ المعاملات التي يحددها مصرف الإمارات العربية المتحدة المركزي. تنتهي صلاحية تسجيل كل عميل عند انتهاء صلاحية الهوية المقدمة من قبل العميل أو بعد عام واحد من تاريخ تسجيل العميل. يجب تقديم إثبات هوية أصليه و صالحه وفقًا لمتطلبات البنك المركزي لدولة الإمارات العربية المتحدة أثناء إجراء معاملة التحويل
2.9 Customer registration is mandatory with valid identification specified by the Central Bank of the UAE for transaction amounts set by the Central Bank of the UAE. The validity of each customer’s registration shall expire upon expiration of the identification provided by the customer or one year from the date the customer was on-boarded. Original valid identification in accordance with the Central Bank of the UAE requirements must be provided while making a remittance transaction.
.إشعار مهم: أي تعديلات أو إعادة إصدار للتحويل لأي سبب كان ستخضع لرسومنا المعتادة وتسوية أي فروق في الأسعار، إن وجدت.
2.10 Important Notice: Any amendments or re-issuance of the Transfer for whatsoever reason will be subject to our regular charges and settlement of any rate differences, if applicable.

2.11 The Recipient must furnish WSEC or the relevant Representative with valid identification or the unique reference number of the Transfer to prove entitlement to receipt of the Transfer.
.وول ستريت للصرافه ليس مزود خدمة الضمان. يوافق المرسل والمتلقي على عدم استخدام الخدمات لأغراض الضمان
2.12 WSEC is not an escrow service provider. The Sender and Recipient agree not to use the Services for escrow purposes.

2.13 Our Service is offered to adults that are aged 18 years and older. The Service must not be used for illegal activities, including for gambling purposes, terrorist financing, fraud or money laundering, or fiduciary deposits.
تخضع جميع التحويلات التي تتم من خلال وول ستريت للصرافه للقوانين المحلية والاتحادية والدولية بالإضافة إلى لوائح البنك المركزي لدولة الإمارات العربية المتحدة. إذا كان لدينا سبب للاعتقاد بأن الحواله أو الخدمة تم أو يجري استخدامها أو يُقصد استخدامها لغرض انتهاك القوانين أو اللوائح أو القواعد أو سياسات وإجراءات وول ستريت للصرافه، بما في ذلك ما يتعلق بقوانين مكافحة الاحتيال والمال غسيل الأموال أو غيرها من الأنشطة غير القانونية، فإننا نحتفظ بالحق في حظر وإلغاء التحويل بشكل دائم وإبلاغ السلطات المختصة به دون إشعار للعميل. تحتفظ وول ستؤيت للصرافه أيضًا بالحق في مصادرة الأوراق النقدية المزيفة أو الشيكات السياحية وتقديمها إلى السلطات المختصة. سيكون المرسل والمتلقي مسؤولين مسؤولية كاملة عن تقديم الأدلة والتوضيحات المطلوبة حول أي استفسار، بما في ذلك مصدر الأموال، لإثبات شرعية وقانونية المعلومات والأموال المعنية وكذلك أي متابعات مطلوبة مع السلطات المعنية للتنفيذ. الدفع أو المطالبة باسترداد الأموال
2.14 All Transfers conducted through WSEC are subject to local, Federal, and international laws as well as the regulations of the UAE Central Bank. If we have reason to believe that a Transfer or the Service has been, is being or is intended to be used for the purpose of violating laws, regulations, codes, or WSEC’s policies and procedures, including with respect to the laws against fraud and money laundering or other illegal activities, we reserve the right to permanently block and reverse a Transfer and report it to the competent authorities without further notification to you. WSEC also reserves the right to confiscate fake or counterfeit currency notes or traveler’s cheques and provide the same to the relevant authorities. The Sender and Recipient will be fully responsible for providing the requisite evidence and clarification about any query, including the source of funds, to prove legitimacy and legality of the information and funds involved as well as any follow-ups required with the concerned authorities to affect the payment or claim a refund.
يجوز لشركة وول ستريت للصرافه تعليق أو إنهاء تنفيذ الحواله نتيجة لأي حدث غير متوقع ، على سبيل المثال بدون حدود: التغيير أو تفسير أو تنفيذ في اي لائحة؛ تصرف أو أمر أو طلب من أي سلطة؛ تقييد أو على وشك التقييد على توفر أو قابلية التحويل أو الائتمان لأي عملة؛ فشل أو تقصير في أي دفع؛ عطل في نظام الكمبيوتر. فشل أو تقصير من مقدم الخدمة أو البائع تجاه وول ستريت للصرافه؛ أي فشل في الإرسال أو سوء الاتصال فيما يتعلق بتعليمات التحويل؛ أو أي حدث آخر خارج عن سيطرة وول ستريت للصرافه. يتحمل العميل مخاطر أي تأخير وخسائر تتعلق بحدث غير متوقع
2.15 WSEC may suspend or terminate the execution of the Transfer as a result of any force majeure event, including, without limitation: change in any regulation or in the interpretation or enforcement of any regulation; act, order or request of any authority; restriction or impending restriction on the availability, convertibility, credit or transferability of any currency; failure or default of any payment intermediary; malfunction of a computer system; failure or default of a service provider or vendor to WSEC; any failure in the transmission of, or miscommunication with respect to the remittance instruction; or any other event beyond WSEC’s reasonable control. The customer shall bear the risk of any delay and losses relating to a force majeure event.

2.16 At any time after a Transfer is instructed, you can contact WSEC in-store to enquire as to the status of the Transfer. WSEC reserves the right to withhold information where it has reason to believe that the provision of information may breach applicable laws, regulations, codes or WSEC’s internal policies and procedures.

2.17 Wall Street Exchange Centre LLC will refund the unclaimed funds as per the guideline of the regulatory authorities.

Foreign Currency Purchase and Sale:

3.1 The rates displayed on WSEC’s website or stores are indicative only and are subject to change. The exchange rate of a purchase or sale of currency may vary from the displayed rates due to various factors affecting the financial markets, including factors outside of WSEC’s control.

3.2 Currency once bought or sold can be returned only with a new transaction at the prevailing market rate.

3.3 You must count your money and verify the genuineness, validity and correctness of the money received from WSEC before leaving the counter and obtain a receipt for your transaction. Neither WSEC nor its employees will be held liable for any claims or shortages thereafter. WSEC has the right to recover any amount paid in excess to the customer due to any errors and oversights.

Limitation of Liability:
لن تتحمل وول ستريت للصرافه بأي حال من الأحوال المسؤولية عن أي مطالبات أو خسائر أو أضرار ناجمة عن التأخير أو عدم التسليم أو عدم قابلية التحصيل أو عدم السداد أو الدفع الناقص للتحويل لأي سبب من الأسباب على الإطلاق بما في ذلك الإهمال من جانب موظفينا وموردينا، الممثلين أو غيرهم، إلا في حدود استرداد مبلغ الإرسال .والرسوم المحصلة من المرسل. لا تتحمل وول ستريت للصرافه أي التزام بدفع الأموال المرسلة إلى المستلم
4.1 In no event shall WSEC be liable for any claims, losses or damages for delay, non–delivery, non–collectability, non–payment, or underpayment of the Transfer for any reason whatsoever including negligence on the part of our employees, suppliers, Representatives or otherwise, except to the extent of refunding the sending amount and charges collected from the Sender. WSEC does not assume any obligation for payment of the sent money to the Recipient.
.لن تتحمل وول ستريت للصرافه بأي حال من الأحوال المسؤولية عن أي خسائر أو أضرار أو تكاليف أو رسوم غير مباشرة أو خاصة أو عرضية أو تبعية أو نموذجية أو عقابية، بما في ذلك و لكن بدون حدود المسؤولية عن خسائر التحويلات بسبب التقلبات في أسعار صرف العملات
4.2 In no event shall WSEC be liable for any indirect, special, incidental, consequential, exemplary, or punitive losses, damages, costs or fees, including but not limited to liability for losses in remittances due to fluctuations in currency rates of exchange.
.ستتخذ وول ستريت للصرافه جميع الخطوات المعقولة لحل أي مشكلات تتعلق بالخدمات التي يقدمها ممثلوها. تحد وول ستريت للصرافه من مسؤوليتها إلى أقصى حد ممكن بموجب القانون عن أي أفعال أو إغفالات من جانب ممثليها. سيكون الممثل مسؤولاً مسؤولية كاملة عن إكمال خدماته وفقًا لشروطه وأحكامه
4.3 WSEC will take all reasonable steps to resolve any issues relating to services provided by its Representatives. WSEC limits its liability to the fullest extent possible by law for any acts or omissions of its Representatives. The Representative will be fully liable for the completion of their services in accordance with their terms and conditions.

4.4 WSEC does not seek to exclude its liability to you for death or personal injury or for any losses caused by our fraud or fraudulent misrepresentation.

Data Protection and Confidentiality:
ستحصل وول ستريت للصرافه على بياناتك الشخصية وتخزنها فقط لأغراض تقديم الخدمات لك، وإجراء فحوصات أمنية وجنائية. قد تتضمن المعلومات التي يتم الكشف عنها البيانات المالية ومعلومات الاتصال والهوية والكمبيوتر وخدمة الإنترنت والجهاز المحمول ومعلومات الشبكة الاجتماعية. قد يشمل مستلمو بياناتك الشخصية الشركات المالية ومقدمي الخدمات والهيئات التنظيمية والوكالات الحكومية. ستكون أي بيانات شخصية مخزنة متوافقة مع قوانين حماية البيانات المعمول بها وسياسة الخصوصية الخاصة بنا
5.1 WSEC will obtain and store your personal data solely for the purposes of providing the Services to you, undertaking security and criminal checks. Information disclosed may include financial data, contact information, identification, computer, internet service, mobile device and social network information. Recipients of your personal data may include financial companies, service providers, regulators and government agencies. Any personal data stored will be in compliance with applicable data protection laws and our Privacy Policy.

5.2 For the purposes mentioned above, you consent to us sharing the information collected with our parent company, affiliated entities, Representatives, service providers, those responsible for implementing the law, and the Sender or Recipient. We will not share your personal data with any party other than to the extent permitted or required by applicable legislation or regulations.
أنت توافق على قيام وول ستريت للصرافه بجمع بياناتك الشخصية ومعالجتها وتخزينها للأغراض المذكورة أعلاه. يرجى الاطلاع على سياسة الخصوصية الخاصة بنا للحصول على مزيد من المعلومات التي يمكن العثور عليها على موقعنا.
5.3 You consent to WSEC collecting, processing and storing your personal data for the purposes mentioned above. Please see our Privacy Policy for further information which can be found on our website.

By clicking the ‘I consent to receiving information about additional products or services’ box when submitting the contact form constitutes an affirmative action by which you have given your consent to data processing for advertising and marketing purposes. You are free to withdraw your consent at any time by informing the Data Protection Officer.

التنازل والتعويضات وإنهاء الخدمة
Waiver, Remedies and Severance:
لا يشكل فشل وول ستريت للصرافه أو تأخيرها في ممارسة أي حق أو تعويض متاح لها تنازلاً، كما لا يجوز أن يمنع أو يقيد أي ممارسة أخرى لهذا الحق أو أي حق أو تعويض آخر. لا يجوز لأي ممارسة فردية أو جزئية لأي حق أو تعويض أن تمنع أو تقيد ممارسة ذلك الحق أو أي حق أو تعويض آخر. الحقوق والتعويضات المنصوص عليها بموجب هذه الاتفاقية هي إضافة إلى وليست حصرية، لأي حقوق أو تعويضات ينص عليها القانون
6.1 A failure or delay by WSEC to exercise any right or remedy available to it shall not constitute a waiver, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy shall prevent or restrict the further exercise of that or any other right or remedy. The rights and remedies provided under this Agreement are in addition to, and not exclusive of, any rights or remedies provided by law.
إذا أصبح أي حكم أو جزء من هذه الاتفاقية غير صالح أو غير قانوني أو غير قابل للتنفيذ، فسيتم اعتباره معدلاً إلى الحد الأدنى الضروري لجعله صالحًا وقانونيًا وقابل للتنفيذ، ويحقق إلى أقصى حد ممكن الهدف التجاري المقصود. نتيجة الحكم الأصلي. إذا لم يكن هذا التعديل ممكنًا، فسيتم اعتبار الحكم أو الجزء ذي الصلة محذوفًا. أي تعديل أو حذف لحكم أو جزء من الحكم بموجب هذا البند لن يؤثر على صحة وقابلية تنفيذ بقية هذه الاتفاقية
6.2 If any provision or part-provision of this Agreement is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable and, to the greatest extent possible, achieve the intended commercial result of the original provision. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this Agreement.
.تحتفظ وول ستريت للصرافه بالحق في تغيير أي من هذه الشروط والأحكام. سيتم إخطار العملاء بالتغييرات عن طريق العرض في متاجر وول ستريت للصرافه وعلى موقعها الإلكتروني. يعتبر استخدام خدمات أو منتجات وول ستريت للصرافه بعد أي تغيير في الشروط والأحكام بمثابة قبول دون التحفظ على الشروط والأحكام الجديدة
6.3 WSEC reserves the right to vary any of these terms and conditions. Customers will be notified of changes by display at WSEC’s stores and on its website. Use of WSEC’s services or products subsequent to any change in the terms and conditions shall be deemed as acceptance without reservation of the new terms and conditions.

7.1 WSEC may inform you about its latest updates, special promotions and offers through SMS. If you do not wish to receive such messages, please call 04-2269871 to opt-out.
.تلتزم وول ستريت للصرافه بتوفير خدمات تحويل الأموال وصرف العملات الأجنبية عالية الجودة. في حالة عدم رضاك التام عن الخدمة، يرجى الاتصال بنا في أقرب وقت ممكن ولكن في موعد لا يتجاوز 14 يومًا من التاريخ المطبوع على إيصالك الذي تتعلق به الشكوى
7.2 WSEC is committed to providing a high-quality money remittance and foreign exchange service. In the event that you are not fully satisfied with the Service, please contact us as soon as possible but in no event later than 14 days from the date printed on your receipt to which the complaint relates.
يجب تقديم أي شكوى متعلقة بالمعاملة خلال مدة أقصاها أربعة عشر (14) يومًا من تاريخ المعاملة. ستبذل وول ستريت للصرافه كل الجهود الممكنة لحل أي مشكلات تتعلق بالخدمات المقدمة من طرف ثالث من خلال التنسيق مع مزود الخدمة المعني. لا تتحمل الشركة أي مسؤولية كوكيل عن أي خدمات ذات صلة. وسيكون الطرف الثالث مسؤولاً مسؤولية كاملة عن إتمام خدمته وفقاً لشروطها وأحكامها. ومع ذلك، بالنسبة للمعاملات غير المصرح بها، يُسمح لك بالإبلاغ عن المعاملات خلال 30 يوم عمل على الأقل
7.3 Any transaction-related complaint should be lodged within a maximum period of fourteen (14) days from the date of the transaction. WSEC will take all possible efforts to resolve any issues for services provided by a third party by coordinating with the concerned service provider. The company has no liability as an agent for any related services. The third party will be fully liable for the completion of its service in accordance with its terms and conditions. Nevertheless, for unauthorized transactions, you are allowed to report the transactions within a minimum of 30 business days.
.سنؤكد استلام شكواك خلال يومي عمل (2) من استلامها وسنسعى لحلها أو تقديم تحديث لك خلال عشرة (10) أيام عمل من رفع شكواك
7.4 We will confirm receipt of your complaint within two (2) business days of receipt and shall endeavor to resolve or provide an update to you within ten (10) business days of your complaint being raised.
